1. Acceptance of Terms

By downloading, installing, or using StayAwake (“the App”), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

StayAwake is a product of Nedati Technologies Private Limited. These terms apply to all users of the App.

2. Description of Service

StayAwake is a macOS menu bar utility that prevents your Mac from going to sleep. The core features include:

• One-click sleep prevention via the menu bar
• Configurable duration options (15 minutes, 30 minutes, 1 hour, 2 hours, or indefinitely)
• Elapsed time display with countdown for timed sessions

We reserve the right to modify, suspend, or discontinue any part of the App at any time without prior notice.

3. License

Nedati Technologies Private Limited grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal or commercial purposes on any Mac you own or control, subject to these Terms.

This license does not allow you to distribute, sublicense, or make the App available over a network where it could be used by multiple devices simultaneously.

4. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works based on the App
• Remove any copyright or proprietary notices from the App
• Use the App in any manner that could damage, disable, or impair your system

5. Intellectual Property Rights

The App and its original content, features, and functionality are and will remain the exclusive property of Nedati Technologies Private Limited and its licensors. The App is protected by copyright, trademark, and other laws.

6. Privacy

Your use of the App is also governed by our Privacy Policy. StayAwake does not collect, store, or transmit any personal data. All processing happens locally on your device.

7. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis. Nedati Technologies Private Limited makes no warranties, expressed or implied, regarding the reliability or availability of the App.

While the App uses the standard macOS power management API, we cannot guarantee that sleep prevention will work in all system configurations or macOS versions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Nedati Technologies Private Limited BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

This includes, but is not limited to, any damages resulting from your Mac sleeping or not sleeping as expected.

9. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Ghaziabad, Uttar Pradesh, India.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Changes will be reflected by updating the “Last updated” date at the top of this page. By continuing to use the App after any revisions become effective, you agree to be bound by the revised terms.
